Do your ‘all-inclusive’ tours include international airfare?
Our all-inclusive international adventure tours include accommodations, meals, activities and all local transportation. Since Adventure Travelers arrive from all over the world to begin these tours, it’s not possible to include international airfare in our prices. However, we’d be happy to help you arrange your flights. Just ask for an ‘air quote’ when making your booking.
Can you help arrange my travel visas?
Currently, none of our available tours require travel visas, which makes things easier. However, if any of our upcoming tours destination require visas, we will help arrange your travel visa and provide you all the necessary resources and instructions upon booking your tour. From start to finish, our team of experts are hand-on, every step of the way.
What is the most appropriate type of luggage to bring and what should I pack?
Travel light and move fast is our motto. Having said that, the way our tours have been designed, you will not have to worry about getting stuck carrying suitcases on and off buses and trains. Furthermore, we provide you with a comprehensive preparation and packing list of everything you need to know and bring for each adventure tour. Simply click on the ‘Preparation and Packing List’ link to download the information.
What clothing should I pack for one of your adventures?
We always recommend packing as light as possible however the specific requirements for your tour will vary widely depending on where and when you are traveling. Our ‘Packing List’ document includes a suggested packing list and these can be downloaded from each individual trip summary page. The checklist is tour specific and based upon the experience of our expert staff.
Do we require vaccinations for any of your adventures?
Currently, none of our tours require vaccination. However, if any of our upcoming tour destinations require vaccinations, we will provide that information and resources to you upon inquiry. Please note: It is important that you receive the most accurate and up-to-date travel health information for the region you will be visiting. The only one qualified to provide you with this advice is your family physician or a specialist from a Travel Health clinic.
How many people can join a tour?
We keep our group sizes low so that you get more personal attention from our adventure guides. Group sizes range from 8 to 16 participants. This intimate size ensures that your group will not crowd your experience.
What are the age restrictions on your tours?
To travel independently you must be at least 18 years of age. There are no upper age limits for our tours as we provide an initial assessment to rule out any pre-existing medical conditions or physical injuries that may prevent your participation. The minimum age required to participate in our adventures ranges from 12 to 14 years of age when accompanied by a parent or legal guardian (maximum of 2 children per adult).
I’m a single traveller, will I be charged a single supplement?
Most of our trips do not have a single supplement. This means that the accommodation is on a twin share basis and, if you are travelling on your own, you will be sharing a room with another G Adventures traveller of the same sex. Some tours have an optional single supplement or rarely a mandatory single supplement.
An optional service that may be available is called “My Own Room”. This service allows solo travellers to request their own private room while on tour. The cost and the details vary by trip, so please contact our office for more details.
Can I change my hotel accommodation?
Some of our destinations do not include hotel rooms but rather tree houses and cave camps. So, if you prefer a specific tree house, I’m sure we can accommodate! For destinations with hotels, they are not available for change, as they are included in the set itinerary.
Can I join a tour late or leave it early?
It’s extremely difficult if not impossible to join a tour after it has begun. It is possible to leave a tour early, however, you will be responsible for your own arrangements from the moment you decide to leave the tour. You would also be responsible for all costs associated with joining a tour late or leaving one early. If you feel this may be necessary please contact our Travel Specialist before booking your tour.
Is local transportation included?
We provide the easiest way to adventure travel by assuring that all your local transportation within your trip itinerary will be covered. You will be responsible for all costs related to personal transportation not included in your itinerary (i.e.; transit or taxis on your free time).
Who are my travelling companions?
For privacy reasons we cannot provide you with advance details on your traveling companions. Our tours appeal to a wide range of travellers, most of whom are health conscious and share an adventurous spirit.
What does your sustainable and healthy brand mean to my trip experience?
Our brand of ‘Adventure Travel, Only Healthier.’, means that the locations you will travel to will be filled with natural, untouched landscapes. Our support for local farming in each of our destinations guarantees that the food you will be consuming is fresh, local and natural. Our physically healthy tours allows us to participate in activities every day, with minimal if no sight seeing – which you are welcomed to do on your free time instead of joining our ‘yoga downtime’. We strive to provide trips that make you feel stronger, enlightened, humbled, clear headed and more energized upon your return.
Can I book extra nights of hotel accommodation before or after my tour?
Yes, in most cases we can arrange additional accommodation at our starting or ending hotels. Our tours are also located in locations where you can easily plan an extended getaway. Please contact our office for more details about extended stay information.
Is tipping included and if not, how much should I budget?
Tips are not included in the tour price. Since our adventure tours are all-inclusive, we recommend tipping at about 5% of the cost of your trip.
We do our utmost to ensure your personal information is safeguarded and protected, by adhering and acting in accordance with all applicable legislation, including Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), and other similar legislation, as applicable in the countries and regions in which Exploration Fitness operates.
WHAT IS CONSIDERED PERSONAL INFORMATION AND WHY WOULD IT BE COLLECTED?
Exploration Fitness collects personal information only to the extent necessary to deliver the services, products, or information you, or an agent or other passenger booking on your behalf, request.
Exploration Fitness, either directly or through our agency and booking partners collects, holds, uses and discloses, only as necessary the following personal information from customers and others in the course of offering services or providing services to you: full name, age, home address, phone number, e-mail address, passport and travel medical information, where required, insurance details, ISIC information, where applicable, nationality, residency, nutrition preferences, trip evaluations, travel & accommodation preferences, comments you provide us, trip destination information, credit card and/or other payment information, etc. The collection of this information is done to allow us to provide services to you as requested.
We may also collect personal information, including contact information, if you elect to enter a contest or sweepstakes with us, to subscribe to our newsletter, or to request a brochure, which we will use only to provide you with the service you have requested (or other substantially similar services directly related to your request).
Exploration Fitness collects personal information from those individuals applying for employment or similar positions at Exploration Fitness to the extent necessary to (i) identify the individual and (ii) evaluate their suitability for the position applied for. This information may include name, contact information, educational and employment background, criminal record information, residency and/or citizenship information, and other information necessary for us to screen potential employees and staff.
Exploration Fitness collects personal information from agents and agencies to the extent required to allow agents to book Exploration Fitness’ trips, and to be properly credited for such booking, as necessary and as dictated by the relationship between the agent and Exploration Fitness. Such information may include name, employment relationship or employer information, work or business address, etc. If you are an agent travelling with Exploration Fitness may collect the personal information noted above for other travelling passengers, as well as other employment or eligibility information. This information may be collected directly from you, or from your employer (where authorized).
Where the collection of certain details of your personal information is not required in order to deliver requested services or products, you may forgo providing such details. For example, you may sign up for our electronic marketing and newsletters with only an e-mail address. You may also be entitled, in certain circumstances where verification of your identity is not required, to deal with Exploration Fitness using a pseudonym. Please ask Exploration Fitness to advise if the personal information in question is required to complete your request.
HOW IS MY PERSONAL INFORMATION USED OR DISCLOSED?
Exploration Fitness uses this personal information to provide the services and/or products you have requested, or to provide you with information about those services or Exploration Fitness. This includes using personal information to: register you to receive newsletters, answer your request for further information about our trips, make a booking or booking(s), provide you with information about the Company and/or our services, and to receive and implement feedback on those services. Furthermore, the personal information allows us to:
• Understand your needs as a customer and determine eligibility for our products and services.
• Inform you about our products and services, or those of our partners that we believe may be of interest to you.
• Provide ongoing service and support, including resolution of any issues with the services or products you request from Exploration Fitness.
• To ensure the safety and security of our passengers and products.
• Carry out internal accounting and administration of our business.
• Comply with laws, regulations, immigrations requirements, and the like.
Exploration Fitness may also use your personal information to book products and services for you or on your behalf from our third party suppliers and service providers, or other service providers or merchants for whom we act as agent from time to time. This collection of personal information can be both for our internal purposes, for example, to process your booking, and occasionally on behalf of the parties for whom we act as agent, for their internal purposes in providing the services or products you have requested. Please be aware that the consent you provide to the collection and use of personal information by Exploration Fitness, applies equally to the parties whose products and services we sell or book on your behalf. For example, if you purchase a flight from us, you will be deemed to have consented to your personal information being provided to the airline to enable your flight to be booked.
WHAT ARE THE CONSEQUENCES OF FAILING TO PROVIDE PERSONAL INFORMATION?
If you do not provide the Personal Information that we request, we may not be able to deliver the services you have requested, which may mean you won’t be able to participate in our trips, purchase the items from our store, or subscribe to our newsletter, to name a few. If you have paid a deposit and later refuse to provide necessary Personal Information to Exploration Fitness require to deliver the service for which the deposit was paid (for example, for a flight which requires passport information), you may not be entitled to a refund for that service. Please contact us if you have any questions about providing or not providing Personal Information when booking or otherwise dealing with Exploration Fitness. Personal information is not collected unless provided to us. This means you can visit and browse our website, or place a call to our 24/7 sales contact centre, without having to provide any personal information to Exploration Fitness. How do we collect this information and obtain your consent? We collect information from customers during the booking (or option) process, or during the inquiry process where required, via our sales channels, such as our website booking form, our 24/7 sales contact centre (via e-mail or telephone), using medical forms filled out by you or your authorized representative, using your MyG profile, through on-line evaluations submitted by you, via on-line or other entry ballot for any contests, competitions, or sweepstakes, using brochure or other similar request forms, and/or through our travel agency partners and other individuals who make or update bookings on your behalf, or otherwise interact with us on your behalf, including during the inquiry process (whether or not the inquiry proceeds to a booking).
This information is provided by you or on your behalf by someone you have authorized to make or inquire about a booking. We obtain consent by:
• Written permission via mail, email or fax, or online booking form.
• Verbal permission
• Third party consent (i.e. from your travel agent, or the passenger booking on your behalf to whom you have provided your personal information for such purpose).
HOW IS YOUR PERSONAL INFORMATION PROTECTED?
The security and integrity of your Personal Information is important to us. All personal information is stored in secure databases at secure addresses to prevent unauthorized access. Passwords, encryption devices and firewalls protect these databases. Please note however that no data transmission over the Internet can be guaranteed to be 100% secure. While we take all steps to ensure the safety of your data, we cannot ensure the security of information you transmit to us over the Internet.
Access to your personal and private information is limited to: authorized employees, of Exploration Fitness, and any of the third-party suppliers who require your information to provide the travel or other services you have requested (such as the airlines, transportation services, hotels, activity providers, and tour guides who deliver the services you purchase through Exploration Fitness or that we arrange on your behalf) . We keep our employees and our third party suppliers and other partners informed about our policies and procedures and require strict compliance with this Policy in order to ensure your information remains protected. Unauthorized access and/or disclosure of client information are strictly prohibited.
WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Exploration Fitness will share your information with the outside suppliers (such as guides, travel companies, hotel companies, insurance companies, equipment suppliers, promotion or sweepstakes co-sponsors, and credit card processing entities etc., all of which may be located outside of your country of residence and governed by differing privacy legislation) who perform services on our behalf. As you would expect, certain information must be provided to these suppliers in order to facilitate your booking and in order to provide you with service(s) you have requested. These partners and suppliers are located all over the world – you can reasonably expect your personal information to be shared with organizations we work with in the countries you are travelling to, and in some cases, to the country of the head office of such third party partner supplier.

Subject to legal restrictions, you can withdraw your consent to our use of your information at any time and with reasonable notice. If you refuse or withdraw your consent for any purpose that is required by us to fulfill our product or service contract with you or the Company, we will not be able to provide you, or continue to provide you, with the product or service.
Exploration Fitness will only send you brochures, newsletters or other promotional and/or marketing materials if you have opted in to receive them. You can subscribe to receive such materials on our website, or by contacting our 24/7 sales contact centre.
Exploration Fitness retains passenger personal information for as long as is reasonably required, with consideration to the purpose for which it was collected or a related or ancillary purpose, and to our legal and regulatory obligations. Exploration Fitness deletes or otherwise destroys passenger personal information after a reasonable period of time. On occasion, you may have to provide your personal information to us again where it has been so deleted.
If you have any complaints about Exploration Fitness’ collection, use, disclosure, or dealing with your Personal Information, if you believe that Exploration Fitness’ is in violation of or have any questions about Exploration Fitness compliance with applicable privacy legislation in relation to your Personal Information, please send a written letter or an e-mail to Exploration Fitness Privacy Officer at email@example.com or at the postal address in the section above. You may also contact Exploration Fitness’ Customer Service team at the information on the Exploration Fitness’ website.
Exploration Fitness takes all complaints regarding your privacy and Personal Information very seriously. Upon receipt, the Privacy Officer will review your complaint within 20 business days and will provide a written response to the return address indicated in the complaint. If such response is not satisfactory to you, we invite you to reply to the Privacy Officer, who will make every endeavor to resolve your concerns.
In the event you provide us with an Opt Out Notice you information will be segregated and not disclosed or used in any manner about which you have objected. However, the personal information we collected may be retained by us if necessary for us to comply with any law or legal directive.
Booking Terms and Conditions
Thank you for booking and/or travelling with Exploration Fitness
These Terms and Conditions apply to any travel products and/or services purchased from Exploration Fitness, and govern the contractual relationship between you and Exploration Fitness with respect to any such travel products and/or services (hereinafter, the “Products”). All Exploration Fitness tours are operated by Exploration Fitness. Your booking contract is with Exploration Fitness (Canada), a Canadian company incorporated in Ontario and authorized sales agent, if so indicated on the applicable invoice.
Please read these Terms carefully as by booking any Product with Exploration Fitness or by travelling on a Exploration Fitness tour or Product you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking on any Products with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions (the “Terms”) on behalf of all clients named in the booking (including minors and those under a disability) and travelling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms. The client who confirmed the booking is deemed to be the designated contact person for all other clients named in such booking.
1. THE BOOKING CONTRACT
A booking is confirmed and these Terms shall apply when Exploration Fitness, or an authorized agent acting on Exploration Fitness’ behalf, have received the applicable deposit from the Client and the Client has received written confirmation from Exploration Fitness of such booking. The Client confirming the booking must be no less than 18 years of age and agrees to provide full, complete and accurate information as requested by Exploration Fitness to confirm such booking. Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to Exploration Fitness that: i) they have all requisite consents and authority to make such booking on behalf of all other Clients named on the booking, and have communicated all necessary information to the other Clients in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with Exploration Fitness for the purposes of completing the booking; and iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with Exploration Fitness.
2. MEDICAL CONDITIONS & MEDICAL FORM
All Clients are obligated to provide requested relevant medical information to Exploration Fitness upon booking their tour Product, and required to complete the Exploration Fitness Medical Waiver Form for their safety.
Fitness participants must also complete and return a PAR Q Fitness Waiver Form prior to commencing any Warrior Fitness Camp or Weekend Warrior.
Clients may also be required to complete and return a PAR Q Medical Form
• (a) a Clients indicates has any pre-existing medical conditions which may have any impact on the Client’s ability to complete activities included in the tour Product, the Client’s ability to travel to remote areas removed from medical facilities, or which may have any impact whatsoever on the Client’s ability to travel or the travel experience of others on the Product tour; that Client must return a Medical Form, duly signed by a licensed, competent and practicing physician, to Exploration Fitness prior to or in conjunction with that Client’s final payment in respect of the applicable booking.
Clients are responsible for assessing their own suitability and capability to participate in the tour Product such Client has booked. All Clients should consult their physician regarding their fitness for travel, and adventure travel in particular. Exploration Fitness encourages all Clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the Client’s travel with Exploration Fitness. Exploration Fitness does not provide medical advice. Certain Products may not be suitable for all people due to restrictions posed by limitations in mobility, physical or cognitive disability, pregnancy or various other physical or mental conditions. It is the Client’s responsibility to assess the risks and requirements of each Product in light of such Client’s limitations, physical and mental fitness and condition, and any medical requirements or issues of such Client. Exploration Fitness may refuse to carry pregnant women over 24 weeks or Clients with certain conditions, if suitable accommodation or alternate Products or services cannot be arranged.
Adventure travel, as offered by Exploration Fitness, by its nature involves visiting remote or less developed regions, where medical facilities may not meet the standards of those found in a Client’s home country. The condition of medical facilities in the countries in which Exploration Fitness operates varies and Exploration Fitness makes no representations and gives no warranties in relation to the standard of such facilities or medical treatment in those regions.
Clients agrees to sign a submit any other separate medical waiver required by outfitters working in conjunction with Exploration Fitness on specific international tours.
3. SPECIAL REQUIREMENTS
Exploration Fitness will endeavor to accommodate the special requests of Clients, including (without limitation) dietary and accommodation requests, but such requests do not form part of these Terms or the contract between Client and Exploration Fitness is not liable for any failure to accommodate or fulfill such requests.
Client Age Requirements: Clients aged 18 at date of first travel are deemed to be adults. On all Products an adult Client over the age of 18 must accompany every 2 Minor Clients (defined as Clients under the age of 18). Unless otherwise indicated in the tour description, or otherwise by Exploration Fitness, the minimum age for Clients travelling on tours is 14 years.
Minors: All Minor Client bookings are subject to review and approval by Exploration Fitness. If the consent of a parent or any other person is required by applicable law, judgment, or decree for any Minor Client to travel, the accompanying adult Client is responsible for securing all such proper consent and ensuring that they and the Minor Client meet all legal requirements to travel on the applicable Family Trip and to enter into and depart from applicable countries and regions. Exploration Fitness will not be responsible for any fees, damages, or losses incurred as a result of any failure on the part of a Client to secure such necessary consents, permits, and approvals.
Each Adult on a booking with any Minor Client is joint and severally responsible for the behavior and wellbeing of all Minor Client(s) on such booking, and expressly accepts these Terms on their behalf, including all assumptions of risk and limitations of liability contained herein. Each Adult on a booking with any Minor Client assumes all responsibility for supervising and monitoring such Minor Client(s). Exploration Fitness does not provide care services for Minor Client(s) and Exploration Fitness and its representatives expressly disclaim any responsibility for chaperoning or controlling any Minor Client(s).
CLIENT ACKNOWLEDGES THAT IS MANDATORY THAT ALL CLIENTS OBTAIN TRAVEL INSURANCE WITH A MINIMUM MEDICAL, EVACUATION, AND REPATRIATION COVERAGE OF CAD$300,000 covering all applicable dates of any travel with Exploration Fitness and this insurance must cover personal injury and emergency medical expenses. On the first day of each Product tour, a Exploration Fitness Tour Leader or other Exploration Fitness representative will verify that all Clients have such insurance in place and coverage as per the required amounts above. It is strongly recommended and encouraged that Client’s also extend their coverage to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client. The Client acknowledges that the cost of the tour does not include any insurance coverage for such Client, and that the
Client is required to obtain separate coverage at an additional cost to the Product tour price. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken so that the insurer may properly cover travel on the applicable Exploration Fitness Product.
5. PRICES, SURCHARGES AND TAXES
Due to the nature of Adventure travel and the prices of the resources on which it depends, the published price of any Product is subject to change at any time, before or after booking confirmation, up to 30 days before the departure of such Product. Tours are priced and advertised exclusive of applicable sales taxes. After a Confirmation Invoice has been issued by Exploration Fitness. to the Client, Exploration Fitness reserves the right to impose surcharges on any Product(s), but only for reasons arising from increases in transportation costs, fuel costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable Product(s), but only where the increase in question is greater than 2% of the original price paid for the Product (excluding add-ons, insurance, and taxes). Exploration Fitness shall provide notice to the affected Client as soon as reasonably possible upon learning of the necessity to impose a surcharge in accordance with this section.
Where the increase in price is greater than 7% of the price of the applicable Product, upon receiving notification from Exploration Fitness the affected Client(s) may elect to either:
• (a) cancel the applicable Product booking without incurring any penalty; or
• (b) accept the change of price.
The Client must notify Exploration Fitness of their election within 14 days of receipt of notice of the increase, or they shall have been deemed to have accepted the price change and have accepted liability for payment of the increase.
From time-to-time Exploration Fitness may offer reduced pricing on selected Product tours. The reduced pricing applies strictly to new bookings, and bookings that have already been confirmed (which for these purposes shall mean bookings in respect of which payment of at least a deposit has been received by Exploration Fitness) are not entitled to the reduced pricing.
All dates, itineraries and prices are indicative only and the price quoted at the time of Booking shall be the applicable price, subject to the surcharges that may be levied in accordance these Terms. Changes, revisions, or other amendments may be made to the particulars contained in any Exploration Fitness brochure or on the Exploration Fitness website before a contract is concluded, and such changes, revisions or amendments shall be incorporated herein as of the date of such amendment.
The Client acknowledges that due to the changing nature of travel, they are responsible for keeping up to date on the details of their travel on the Exploration Fitness website, including, but not limited to checking the website at least 72 hours prior to departure to ensure the Client has the most current Trip Details for the relevant Product tour as minor changes may have been made since the confirmation of booking.
Tours and Independent Tours: At time of booking any Product, a 30 Day refundable deposit of CAD$350, as applicable, per person per tour is due from the Client to Exploration Fitness. If the booking is made 60 days or less prior to departure, full payment is due at the time of booking. The refundable deposit should be sent to Exploration Fitness or to the authorized Agent through whom the Client has booked, depending on the original form of booking. Exploration Fitness-designated tours, or certain Products combined with other forms of Products may require a higher deposit or full payment at the time of booking, which will be advised prior to the confirmation of such booking.
Reusable Deposits: Should the Client cancel their booking (for any reason other than nonpayment or any other breach of these Terms), after 30 Days of purchase, the deposit amount as defined above, will be held as a “Reusable Deposit” with Exploration Fitness, subject to the full extent of these Terms. Reusable Deposits have a one year expiry and may be applied, by the Client who originally made the cancelled booking in respect of which such Reusable Deposit was originally received, towards payment of a deposit on any other Exploration Fitness Product. Any additional costs, such as permit costs above the deposit amount are subject to different terms and conditions and do not form part of such Reusable Deposit. The Reusable Deposit has no cash value and is non-transferable. Only one Reusable Deposit may be applied per Client, per Product booked. All Reusable Deposits must be applied to a new Product booking that is of equal or greater value than the Product in respect of which such Reusable Deposit was originally received. A Reusable Deposit may not be applied to the same or similar dates of travel or a Product at a price lower than the Product which was cancelled and/or in respect of which the Reusable Deposit was originally received.
8. CLIENT DETAILS REQUIRED FOR BOOKING
As a condition to valid confirmation of any booking with Exploration Fitness (including all Products) the Client must provide all necessary information as requested by Exploration Fitness along with their final payment. If the Client fails to provide such information prior to the day full payment is due in respect of the relevant Product, an Administrative Fee will be charged to the Client in respect of any costs payable by Exploration Fitness as a result of the Client’s failure to timely provide the required information. In addition, if the Client fails to supply required information for certain Product inclusions such as air tickets, permits, and other inclusions, Client shall bear all responsibility and liability for any failure to obtain or provide such inclusion due to the Client’s failure. Exploration Fitness also reserves the right to treat such booking as cancelled and levy any cancellation fees deemed reasonable by Exploration Fitness, in its sole discretion, where Client has not provided full booking details as requested by Exploration Fitness by the relevant time. The information required from each Client will vary tour by Product purchased, and the requirements will be communicated to the Clients, or to Exploration Fitness’ authorized agent, during the booking process. Exploration Fitness will not be held responsible for any fees levied on the Client as a result of inaccuracies, late, misplaced, or otherwise incomplete or ineligible information provided by the Client.
Product tour prices do not include international airfare or any other flights unless expressly mentioned in the inclusions. Exploration Fitness will quote the best price available at the time of quoting for the travel dates requested. Quotes provide an indicative price only, and represent no price commitment by Exploration Fitness or the applicable airline(s). Exploration Fitness acts only as a sales agent for the applicable airline and the terms and conditions of the air ticket apply to the purchase and use of such ticket. Please consult the air carrier’s applicable terms and conditions and/or conditions of carriage for important information regarding cancellation terms, limitations of liability, and other disclaimers. Exploration Fitness is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air tickets or flight status or delays.
10. FINAL PAYMENT & ACCEPTANCE OF BOOKING
Clients should refer to the confirmation invoice sent by Exploration Fitness and/or its authorized agent and/or their applicable confirmation email for details regarding final payment for any Products booked. Payment of the balance of the price for any Product is due 60 days before the departure date of the first Product to depart (of the Products included in such booking). If full payment is not received by such due date, Exploration Fitness may change the rate payable for the Product, or may treat the booking of such Product as cancelled and shall retain the deposit paid on booking as a cancellation fee, at Exploration Fitness’ sole discretion. If a Product is booked less than 60 days before the departure date of the first Product to depart (of the Products included in such booking), then the full amount is payable at the time of booking in order for the booking to be confirmed. If, for any Product, payment terms differ from those outlined in this section, the applicable terms will be communicated to the Client prior to booking and shall also be detailed on the applicable invoice.
Exploration Fitness is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of Products and will not refund or return any fees charged by such third parties in connection with payments made by Clients to Exploration Fitness.
11. CANCELLATION BY THE CLIENT
A Client may cancel their booking by notifying Exploration Fitness or their booking Agent, where applicable. The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by Exploration Fitness and are expressed hereinafter as a percentage of the total price paid for the cancelled Product, excluding any insurance products.
Cancellation for Tour Product and Independent Tour Product:
• (a) Cancellation received 60 days or more before departure of first Product to depart in relevant booking: Reusable Deposit shall be held by Exploration Fitness in accordance with the terms hereof, the remainder of the payments made by the Client to Exploration Fitness in respect of the cancelled Product shall be refunded to the Client.
• (b) Cancellation received 59-30 days before departure of first Product to depart in relevant booking: Reusable Deposit shall be held by Exploration Fitness in accordance with the terms hereof, an amount equal to 50% of the remainder of the payments made by the Client to Exploration Fitness in respect of the cancelled Product shall be refunded to the Client.
• (c) Cancellation less than 30 days before departure of first Product to depart in relevant booking: Reusable Deposit shall be held by Exploration Fitness in accordance with the terms hereof, and no further refund shall be payable to the Client.
12. GUARANTEED DEPARTURES & CANCELLATION OF A TOUR BY EXPLORATION FITNESS
Exploration Fitness guarantees all scheduled Product tour departures that have been booked by a Client shall depart as scheduled (subject to reasonably itinerary changes as contemplated elsewhere in these Terms). Brochures, and other printed materials displaying tour information and departure dates are subject to change, and such dates are excluded from this guarantee. A departure shall become guaranteed once at least eight Clients has a confirmed booking upon it (secured, at minimum, via valid payment of a deposit). This guarantee is not applicable in Force Majeure situations, as herein defined.
If a tour is cancelled by Exploration Fitness before the agreed date of departure for reasons not arising from Force Majeure or the fault or negligence of or within the reasonable control of the Client, the Client shall have the choice of:
• (a) accepting from Exploration Fitness a substitute tour Product of equivalent or superior value, where such substitute is reasonably available; or
• (b) accepting from Exploration Fitness a substitute tour of lower value if no tour of equivalent or superior value is reasonably available, and to recover from Exploration Fitness the difference in price between the price of the tour originally purchased and that of the substitute tour; or
• (c) accept from Exploration Fitness a full refund of all monies paid for the cancelled tour Product(s).
Exploration Fitness is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. Exploration Fitness reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where after departure a significant element of the Product(s) as described cannot be provided, Exploration Fitness will make suitable alternative arrangements for the continuation of the trip Product(s). If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, Exploration Fitness will provide the Client a refund of unused Products or Product portions.
Financial Security & Consumer Protection
Exploration Fitness is a member of TICO (Member No. 2911023).
13. TRAVEL DOCUMENTS
The Client is entirely responsible for securing and must be in possession at all times while on a Product tour of a valid passport required for entry, departure and travel to each country or region visited or traveled through throughout the itinerary of the applicable Product tour, and for re-entry to the Client’s country of residence or departure (passport must be valid 6 months past the last date of travel with Exploration Fitness), as well as all visas, permits and certificates including vaccination certificates, insurance policies, required for entry into all regions and participation in all parts of the Product tour itinerary. The Client accepts full responsibility for obtaining all such documents, visas and permits prior to the start of the Product tour, and is solely responsible for any adverse consequences resulting from missing or defective documentation. Client agrees that they are responsible for the full amount of any loss or expense suffered or paid by Exploration Fitness which are a direct result of the Client’s failure to secure proper travel documentation. Exploration Fitness does not represent or warrant the accuracy of any information or advice given by Exploration Fitness regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. and Client agrees that Exploration Fitness is not responsible for any errors or omissions in such information.
14. FLEXIBILITY & UNUSED SERVICES
The Client acknowledges by booking a Product and/or agreeing to travel with Exploration Fitness that the nature of adventure travel requires considerable flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by Exploration Fitness. The Client acknowledges their understanding that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Product will be operated, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Exploration Fitness and that Exploration Fitness is not liable to any Client for such changes or amendments.
Exploration Fitness shall not be liable for or pay any discounts or refunds for missed or unused services which were missed or unused by the Client due to no fault of Exploration Fitness, its agents, or representatives, which shall include any termination of the Client’s participation in the tour Product due to the Client’s own fault, negligence or breach of these Terms.
Changes made by Exploration Fitness: Reasonable changes in the itinerary of any Product may be made where deemed necessary or advisable for operational reasons by Exploration Fitness, in its’ sole discretion. If Exploration Fitness makes a Material Change (defined as a change affecting at least one in three full tour days of the itinerary, or which materially affects the character of the Product in its entirety) to any Product, Exploration Fitness will inform the Client(s) booked on such Product of any Material Change as soon as reasonably possible, provided that there is sufficient time before departure to properly notify all affected Clients. If a Material Change is made more than 14 days prior to departure, the affected Client may elect to:
• i) accept the Material Change and proceed with the amended Product;
• ii) book another Product of equivalent or greater value, if available (Client shall be responsible for paying any difference in price between the amended Product and the Product booked in its place);
• iii) book another Product of a lower value, if available, with a refund payable to the Client of the difference in price; or
• iv) cancel and receive a full refund of all monies paid in respect of the land-only portion of the applicable Product (and for clarity, this shall not extend to additional Products booked by the same Client which are not subject to any Material Change).
The affected Client must notify Exploration Fitness or their travel agent of their decision within 7 days of receiving the notification of alteration, or they shall have been deemed to accept the Material Change and deemed to have agreed to the amended Product itinerary.
Once a Product tour has departed, changes to such Product’s itinerary may be necessary or advisable as a result of unforeseen circumstances or other reasons related to effective Product operation, health, safety, Client enjoyment, or Client comfort. Any such changes are at the discretion of Exploration Fitness. The Client acknowledges that they must have reasonable financial resources to cover incidental expenses on every Product on which they travel, whether or not they arise from a change in the itinerary or from the travel itself, and that Exploration Fitness shall not be liable for any Client’s failure to prepare adequately for their travel and unforeseen circumstances which may arise during such travel. Exploration Fitness will not be liable for any indirect and or consequential losses associated with any changes to a Product’s itinerary.
Changes made by the Client: Client is responsible for ensuring that information provided to Exploration Fitness in making their booking is accurate, up-to-date, and correct. Bookings are not transferable to other Products. Any changes to the travelling Client’s name on any Product booking are subject to Exploration Fitness’ approval. Any changes to a file will depend on availability and will be on a request basis and subject to Exploration Fitness’ approval. Any extra costs incurred for making the change will be charged to the Client along with an administrative fee. No changes are permitted to any booking within 10 days of departure of the first Product to depart under the applicable booking.
16. CLIENT’S ACCEPTANCE OF RISK
The Client acknowledges that the nature of Product tours is adventurous and may involve a significant amount of risk to Clients’ health and/or safety. There are dangers inherent to adventure travel generally and Client acknowledges they have considered such risks to health and safety and are willing to assume it, by confirming their booking of such Product. The Client hereby assumes all such risk and does hereby release Exploration Fitness from all claims and causes of action arising from any losses, damages or injuries or death resulting from these risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Product itineraries. Standards of hygiene, accommodation and transport in some countries where Product tours take place are often lower than comparable standards than what the Client may reasonably expect in their home country or region.
The Client acknowledges that the degree and nature of personal risk involved depends on the nature of the Product booked, or the location(s) in which such Product is to operate, and that there may be a significant degree of personal risk involved in travel on the Product, particularly if such Product involves physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with under-developed infrastructure. The Client acknowledges she or he has considered the potential risks, dangers and challenges in light of their own personal capabilities and needs, and expressly assumes the risks attendant to travel under such conditions. The Client acknowledges and agrees that Exploration Fitness is not responsible for providing information or guidance to the Client with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where Products are operated.
The Client must at all times strictly comply with all applicable laws and regulations of all countries and regions visited on the applicable Product tour. Should the Client fail to comply with the above or commit any illegal act when on the tour or, if in the opinion of the Exploration Fitness (acting reasonably), the Client’s behavior is causing or is likely to cause danger, distress or material annoyance to others, Exploration Fitness may terminate that Client’s travel arrangements on any Product immediately without any liability on Exploration Fitness’ part and the Client will not be entitled to any refund for unused or missed services or costs incurred resulting from the termination of the travel arrangements, including, without limitation, return travel, accommodations, meals, and/or incidentals.
Clients agree that they are responsible for any costs incurred by Exploration Fitness’ suppliers or Exploration Fitness’ partners, as a result of damage, destruction, theft, or excess cleaning fees caused or occasioned by the Client while on tour. Clients agree to immediately report any pre-existing damage of this kind to staff of the accommodation, transportation service, or facility (as appropriate) and/or a Exploration Fitness’ representative as soon as possible upon discovery by the Client.
Client agrees to take all prudent measures in relation to their own safety while on any Exploration Fitness tour Product, including, but not limited to, the proper use of safety devices such as seatbelts, harnesses, and helmets, and obeying all posted signs and warnings in relation to Client health and safety. Exploration Fitness, nor its Third Party Suppliers (as hereinafter defined) shall not be liable for any failure on the Client’s part to comply safety instructions or recommendations of Exploration Fitness or its Third Party Suppliers.
Client agrees to bring any complaints regarding a Product to Exploration Fitness as soon as possible in order to provide Exploration Fitness with the opportunity to address such complaint properly. Client agrees to inform the Tour Leader or other designated Exploration Fitness representative at the earliest opportunity, or to the Exploration Fitness local Office Manager at the nearest location to the applicable Product tour, or to Exploration Fitness’ Customer Service department directly. Exploration Fitness assumes no liability for complaints that are not properly brought to the attention of Exploration Fitness with sufficient notice for Exploration Fitness to resolve or attempt to resolve any Client complaints. Any complaint made after the completion of a Product tour must be received in writing by Exploration Fitness via its Agents or directly within 30 days of the end of the tour Product in question.
17. EXPLORATION FITNESS IS NOT LIABLE FOR ITS THIRD PARTY SUPPLIERS
Exploration Fitness is merely the sales agent for Exploration Fitness makes arrangements with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (“Third Party Suppliers”) to provide you with the travel services and other services you purchase or which form the component parts of your product Tour. Third Party Suppliers may also engage the services of local operators and/or sub-contractors for the provision of travel services that form part of the product Tour(s). Although Exploration Fitness takes all reasonable care in selecting Third Party Suppliers, Exploration Fitness is unable to control Third Party Suppliers and do not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. The travel services and other services provided are subject to the conditions imposed by these suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the supplier. Client acknowledges that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and Exploration Fitness does not warrant that any Third Party Supplier is in compliance with the laws of the Client’s country of residence, or any other jurisdiction.
EXPLORATION FITNESS ARE NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY OTHER THAN EXPLORATION FITNESS, AND ITS EMPLOYEES. For clarity, Exploration Fitness, is NOT liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.
18. OPTIONAL EXTRAS
All-inclusive adventure tours include all activity stated in itinerary, local transportation, meals, or any other product or service included in the Product description or itinerary, or in the price of the Product) . Client agrees that any additional assistance given by Exploration Fitness’ Tour Leaders or other Exploration Fitness’ representative in arranging, selecting, or booking, any Optional Extras is purely at the request of the Client, and Exploration Fitness makes no warranties regarding such information and expressly disclaims any liability whatsoever arising from any Optional Extras or participation thereon by any Client, or any information provided by any Exploration Fitness representative or Tour Leader regarding any Optional Extras. Accordingly, the Client hereby releases Exploration Fitness from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in Optional Extras.
All Clients must ensure that they are fit and healthy to undertake all activities and complete a medical waiver, informing Exploration Fitness and its representative of any food allergies. The Client does not hold Exploration Fitness responsible for any injury or illness occurring from the lack of information from the client to Exploration Fitness.
Any Client using such services or activities shall be deemed to agree and consent that any liability for any loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property shall be the sole responsibility of the provider of such service or activity.
Exploration Fitness is not responsible for any damages, expenses, losses, or claims which are attributable to the fault of any Client, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the Product(s), or a force majeure event (as herein defined).
Exploration Fitness shall have no liability for loss, theft of or damage to baggage or personal effects of Clients while participating in a Product tour. Clients should not leave personal belongings unattended in any public areas, on board any mode of transportation, or elsewhere, and are responsible at all times for their own effects and belongings. Exploration Fitness cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Exploration Fitness such as hotels, homestays, vessels, expedition vehicles, or any other mode of transportation.
In the event that any loss, death, injury or illness is caused by the negligent acts and/or omissions of Exploration Fitness or of the third-party suppliers of any services which form part of the Contract then Exploration Fitness limits its liability, where applicable by all applicable International Conventions.
20. FORCE MAJEURE
Exploration Fitness shall not be liable in any way to the Client for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for Exploration Fitness failure to commence, perform and/ or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Exploration Fitness; or an event which Exploration Fitness or the supplier of services, even with all due care, could not foresee.
21. IMAGES AND MARKETING
The Client agrees that while participating in any Exploration Fitness Product tour (including, without limitation, Weekend Warrior, Warrior Fitness Camps and other tour product) images, photos or videos may be taken by other Clients and/or Exploration Fitness representatives or Tour Leaders that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Exploration Fitness, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.
In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from these Terms or amended accordingly only to such extent necessary to allow all remaining terms and conditions hereof to survive and continue as binding. If any provision of these Terms is found to be so broad as to be unenforceable, such provision shall be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision.
24. CONTRACT PARTIES & SUCCESSORS
These Terms and Conditions shall inure to the benefit of and be binding upon Exploration Fitness and the Client and their respective heirs, legal personal representatives, successors and assigns, as well as anyone named in any booking made by the booking Client on whose behalf the Client is purchasing any Product.
Your booking contract is with Exploration Fitness, which exists under, and is pursuant to, the laws of Ontario with its registered office being 1355 Uxbridge Pickering Townline Rd, Uxbridge, Ontario, Canada.
Exploration Fitness tours are operated by Exploration Fitness (herein, “Exploration Fitness”), which exists under the laws of Ontario.
25. APPLICABLE LAW
The Contract and these Terms and Conditions are subject to the laws of Ontario, Canada and all Clients submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada for the resolution of any dispute under these Terms or concerning a Product.
Exploration Fitness reserve the right to update and/or alter these Terms at anytime, and shall post the amended Terms on the Exploration Fitness Website. Any such amendment shall take effect 10 days following their posting to the Website. The latest Terms, as amended, may be provided to Client upon their written request to Exploration Fitness. Clients shall be deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on the Exploration Fitness’ website. Exploration Fitness recommends that all Clients refer to the Terms prior to their travel to familiarize themselves with the most up-to-date version hereof.
I have been informed and am aware that ADVENTURE TRAVEL CAN BE DANGEROUS and includes many risks and dangers, including, but not limited to, the hazards of traveling by raft, by air, on foot or by other unconventional means, accident or illness in remote places without medical facilities, dangers of wild animals, forces of nature, acts of God, extreme weather conditions, physical exertion for which I may not be prepared, and evacuation difficulties, should I be injured or disabled. I have been informed and am aware of these and other inherent risks of the proposed trip and I accept them and acknowledge that the enjoyment of adventuring beyond normal safety of home and work is in part of the reason for my participation in this trip.
In full recognition, and in consideration of being granted a reservation and acceptance for my participation in an adventure vacation under the auspices of EXPLORATION FITNESS, its agents, associates, assigns, employees, officers, licenses, and successors in interest (hereafter ‘EF’), I herby agree as follows: I HEREBY RELEASE, WAIVE, INDEMNIFY and AGREE NOT TO SUE EF for all or any liability to me, my personal representatives, heirs, assigns and next of kin, for any and all loses, damages or injuries or any claim or demand on account of any injury to my person or property, or on account of my death resulting from any cause, except in the case of gross negligence by EF or others, while I an participating in an EF expedition.
I further agree that I will assume the risk and release EF, except in the case of
gross negligence, of all liability for any injury or damage to my body or property or my death due to any negligent failure to obtain or administer appropriate rescue operations in the event of injury or mishap, including failure to obtain adequate medical services, to evacuate or to supply treatment, medicine, or trained rescue personnel.
I FURTHER AGREE that if I am injured or become ill, EF may, at my cost, arrange
or supply medical treatment, evacuation or any other emergency services on my behalf as
EF deems necessary or appropriate for my safety and well being. I EXPRESSLY ACKNOWLEDGE and AGREE that ADVENTURE TRAVEL, INCLUDING THE EF TRIP IN WHICH I AM PARTICIPATING CAN BE DANGEROUS and involves serious and unpredictable risks of bodily injury, property damage and death and that I intend the foregoing waiver and release of EF to be as broad and inclusive as permitted by law; that I am not relying on any oral or written representations of EF regarding safety, and that I am entering this agreement of my own free will.
Release Of Liability And Assumption Of Risk
I HAVE READ AND AGREE to the policy on cancellations and refunds as stated under General
Terms and Conditions. I am aware that should I choose not to purchase insurance coverage as put forth under the “insurance” subhead of General Information, I will be liable for all costs in the case of cancellation, trip delays, damage or loss of baggage and medical emergency howsoever caused.
I FURTHER AGREE that any controversy or claim arising out of or relating to my participation in an EF trip and/or this Agreement, or the making, performance or interpretation thereof, shall be settled by binding arbitration in Kingston, New York in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over EF and the subject matter of the controversy.
I FURTHER AGREE that I will have no illegal drugs on my person in my possession when
partaking in any part of any EF tours.
I HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS RELEASE OF LIABILITY
AND ASSUMPTION OF RISK AND AGREEMENT.
Exploration Fitness, Earth River & It’s Affiliates (the ‘Company’) acts only as an agent for hotels, hostels, airlines, adventure tour companies, insurance companies and other providers of travel and related services to the Traveler (the Suppliers). As such, and while the Company makes efforts to ensure that the quality of the services rendered by the Suppliers is consistent with the descriptions provided, the pictures, photographs and descriptions included in any printed material or online do not constitute any form of representation, warranty or guarantee that all of the attributes will be as depicted. All coupons, exchange orders, receipts, contracts and tickets are issued subject to any tariffs, terms and conditions under which such services are provided by the Suppliers. The Company, its affiliates, agents and employees assume no responsibility and shall not be liable for any loss, damage or other claim,
whether to person or property, that does not arise directly as a result of negligence of the Company its affiliates, agents or employees in facilitating the Customer’s purchase of Supplier services.
The Company acts as a guidance and booking agency for travel related service. While the Company makes every effort to assure all costs are explained and depicted in advance certain costs may arise that have not been mentioned and/or foreseen. The Traveler accepts these costs and in no way holds the Company responsible. Health and Safety is a major priority of the Company. I understand that the Company does not engage personnel qualified to provide medical, dental, health or other similar care or services to travelers. Therefore, I agree to pay all costs and expenses incurred directly or indirectly. I also acknowledge that high risk and dangerous activities will be undertaken as part of the program, any injury, loss of life or limb as a result of these activities are assumed and known and I will not hold the Company or its personnel responsible in anyway including but not limited to financial obligations.
Trip movement has been carefully planned and mapped out to assure provide the best quality experiences. I understand that should I miss a flight, bus departure or any other form of provided transportation due to my own negligence I accept all responsibility and costs in rejoining the trip at a future destination. Personal consumption of alcohol is at the traveler’s discretion. All use of alcohol must be used within the guidelines of the legal regulations by the country of visitation. Violation of these laws are assumed risks and consequently responsibly by the traveler and not the Company. The use of illegal substance is forbidden and is subject to legal ramifications and dismissal from the program.
Abusive, destructive, violent, bullying or unsafe behavior is not
permitted, Theft or vandalism is also no permitted. Violation of this may result in dismissal from the program at the discretion of the Company and is at my own expense.
The Company works with wholesalers, agents and sales representatives across many platforms. In the rare case one of these sales agents defaults on payment on behalf of the participant the participant will not be eligible to continue with the program and all financial objections, recovery and liability will be with the sales agent and not the company. I understand I will not be able to claim a refund for lost funds through the Company if my portion of funds were never transferred over from my sales agent.
The Company and its representatives shall not be responsible for a traveler’s lost, stolen or damaged personal belongings. The Company reserves the right to dismiss any traveler from the program that staff believe, in their discretion, presents a safety concern or medical risk, is disruptive, or otherwise conducts him or herself in a manner detrimental to the program. If traveler is dismissed or departs from the trip for any reason, no refunds will be granted. I am responsible for all costs of early departure, whether for medical reasons, dismissal, personal emergencies or otherwise. The Company is not responsible for costs incurred by participants in preparing for a program that is altered or cancelled.
The Company is not liable for any losses or damages, personal injury or damage to personal belonging of any kind whatsoever that you may suffer or be subject to arising out of, during, or as a result of your participation with the Company. You will have no claim against the Company.
2 The Company will push and encourage all participants to exercise and workout as a level that is unknown or new to a participant. It is at my own responsibility to regulate and control workouts to prevent myself from injury or personal bodily harm. I in no way will hold the Company responsible for any injury, death or harm caused to myself or others as a result of my participation in any aspect of the program.
The Company may use contracts with individuals or organizations that are independent contractors (not their employees or agents) to provide services to participants at their discretion. Although the stated companies have made efforts to locate responsible contractors, they do not supervise or control these contractors and are not legally liable or responsible for their conduct.
For U.S. or non-Canadian participants and their parent/s: we agree that the substantive laws of Michigan
(without regard to its conflict of law rules) govern this Document, any dispute we have with Student Abroad Travel
and all other aspects of our relationship with the Company, and that any mediation, suit, or other proceeding must be filed or entered into only in Oakland County, Michigan. We agree to attempt to settle any dispute (that cannot be settled by discussion) through mediation before a mutually acceptable Michigan mediator. For Canadian participants and their parent/s: we agree that the substantive laws of the Province of Ontario, Canada (without regard to its conflict of law rules) govern this Document, any dispute we have with the Company and all other aspects of our relationship with the Company, and that any mediation, suit, or other proceeding must be filed or entered into only in the Province of Ontario, Canada. We agree to attempt to settle any dispute (that
cannot be settled by discussion) through mediation before a mutually acceptable Canadian mediator.
This Document is intended to be your legally binding contract to the program and fees associated with it. By signing and returning this document you agree to the terms and conditions set forth by the Company and its representatives, failure to attend the program or abide by the systems, procedures and program details will result in a full payment still being required.
This Document is intended to be interpreted and enforced to the fullest extent allowed by law. If any portion of this Document is deemed unlawful or unenforceable, it shall not affect the remaining provisions, and those remaining provisions shall continue in full force and effect.
I have read the provided materials, spoken with a representative of Exploration Fitness as a member of the ‘Company’ and feel properly informed by the Company about the program and my participation of my choice. I agree to all the above policies and to participate enthusiastically.
My signature below confirms that I have read, understood, and agreed to abide by the terms, conditions and rules as detailed above. I agree that all information written and given to the Company is entirely correct. I allow the Company to send me program information, and updates via email as well as forward my name and address to other participants who may wish to share a room for any travel options and to participants placed on the same program or traveling on the same flight. Any stories or photographs in which the participant appears may be used for the Company promotional literature.
